傳統責任保險僅涵蓋第三人之損害賠償,本專案旨在規劃一個土污專責的污染 保險,將污染所致的整治費用納入承保範圍,以便在污染情事發生時,能確保環境 污染復育工作之推動。即潛在污染責任人或土地關係人透過購置土壤及地下水污染 責任保險,可達到分散土壤及地下水污染之整治與賠償風險。惟國內保險市場並未 開發涵蓋土壤及地下水污染之整治費用的土污責任保險,除了喪失法規鼓勵相關義 務人購置污染責任保險的美意;企業在污染事故發生時,可能因無法支付鉅額的整 治費用及賠償,而陷入經營困境,甚至破產。此外,土污責任保險的推動亦可保障 污染受害者的權益,俾便於污染發生時,順利進行整治及求償。因此,本計畫擬應 用保險經營之專業,探討並規劃土壤及地下水污染責任保險,以消化及吸收因污染 衍生之整治費用及賠償責任。 本研究參照國外之污染保險保單規劃土污專責之污染保險,並擇台灣上市櫃之 油電燃氣業、化學工業、鋼鐵工業、半導體業及光電業為研究對象以問卷進行調查, 實證結果發現各項風險認知並未呈現產業別差異。其次,突發及漸進式污染事故均 會影響潛在污染人的風險知覺,然潛在污染人對突發污染事故造成損害的擔憂程度 甚於漸進式污染。此外,受訪者較擔心員工疏失及廢棄物污染造成的損失,但普遍 輕忽自身產業的污染特質及運輸過程可能產生的污染損害。最後,本報告初擬保險 業經營污染保險之精算、核保、再保及理賠等機制。

Traditional liability insurance pays for covered loss that any damage to a third party. This project aims to enlarge the coverage to any necessary removal expenses and remediation costs induced by pollution will be covered by insurance to ensure the implementation of restoration for environmental pollution. Therefore, by purchasing the land and groundwater related liability insurance, the potential polluter or the interested party of the polluted land will help related businesses to share the risk of soil pollution remediation and compensation. However, since there is no soil and groundwater remediation costs related pollution liability insurance in the domestic insurance market, related obligated persons will not be able to purchase related liability insurance in accordance with the regulations. Therefore, this project tends to explore and draw up plans for the soil and groundwater related pollution liability insurance. Referring to the soil pollution insurance covered by foreign insurance policies, this study chooses Taiwan’s listed companies in gas and electricity industry, chemical industry, steel industry, semiconductor industry and optoelectronics industry, to perform an investigation by questionnaire. The empirical results indicate that each risk perception does not demonstrate a difference among industries. Next, both sudden and accidental pollution and gradual pollution will affect the risk perception of potential polluters. However, potential polluters worry about the damage caused by sudden and accidental pollution events more than the damage caused by gradual pollution events. In addition, interviewees worry more about the damage caused by employee carelessness and waste pollution, but generally neglect the pollution characteristics of its own industry and the possible polluted damage occurred during the transportation procedure. Last, this paper intends to develop a mechanism of actuary, underwriting, reinsurance and claim for environmental pollution insurance policies.
